FMCSA Emergency Declaration: Hurricane Ian

The Federal Motor Carrier Safety Administration (FMCSA) issued an emergency declaration covering several states in the Southeast in anticipation of the significant impacts of Hurricane Ian.

The emergency declaration waives hours of service requirements for the transportation of “supplies, goods, equipment, fuel, and persons.” The waiver applies only to the transportation of supplies that provide direct assistance to the emergency relief efforts in the affected states.

The emergency declaration applies to:

· Alabama

· Florida

· Georgia

· Kentucky

· Mississippi

· North Carolina

· South Carolina

· Tennessee

The emergency declaration expires on October 28, 2022. You can download the FMCSA emergency declaration here.

The National Association of State Energy Officials (NASEO) developed a guidance document on emergency declarations and waivers for state government. For more information, please contact NPGA’s Eric Sears at esears@npga.org.
